Wastewater Discharge Permits. Wastewater is comprehensively regulated under the Federal Clean Water Act and the Virgin Islands equivalent administered by the Department of Planning and Natural Resources (DPNR). We assist commercial and industrial dischargers in issues related to obtaining their Territorial Pollutant Discharge Elimination System (TPDES) permits. We also help coastal zone developers integrate TPDES requirements and Virgin Islands Water Quality Standards into their development permit requests.
Groundwater Issues. The use of surface and groundwater is regulated locally under the Virgin Islands Water Resource Conservation Act. We work with developers in assuring an adequate groundwater and water supply and in obtaining appropriation and well driller’s permits.
Threatened and Endangered Species. In the Virgin Islands, the protection, conservation and management of indigenous fish, wildlife and plants, and threatened and endangered species is embodied in several local and federal laws. We advise land owners, developers on threatened and endangered species issues, including habitat assessments; development of incidental take permits; issues associated with non-listed species; recovery plans; and integrating threatened and endangered species issues with other agency permitting.
Contaminated Lands. A Brownfield/Voluntary Clean-up Program is currently being proposed for the Virgin Islands. Until a formal program is in place, we continue to handle environmental issues that arise in the context of real estate transactions involving contaminated lands.
Solid Waste Issues. Solid and hazardous waste is managed federally under the Resource Conservation and Recovery Act (RCRA) and locally under the Solid and Hazardous Waste Management Act. We handle solid waste disposal issues in development permitting, disposal site operation, planning and closure and drycleaner disposal issues, as well as other hazardous waste disposal issues under RCRA.
Air Pollution. Air Pollution is regulated under the Clean Air Act and the Virgin Islands Air Pollution Control Act. We assist clients in obtaining permits for the construction and operation of air pollution sources. We also regularly advise contractors and developers regarding the applicable air pollution control rules and regulations.
Environmental Process Issues. We defend clients in administrative actions brought by the Division of Environmental Protection (DEP).
